Terms & Conditions (Gift-Compatible Edition)

1. Application & Subscription

1.1. Open Water subscriptions may be purchased either for yourself or as a gift for another individual (the “Subscriber”).

1.2. Where the subscription is purchased as a gift, the person making payment (the “Purchaser”) agrees to these Terms & Conditions on behalf of the Subscriber at the point of purchase.

1.3. The Purchaser is responsible for ensuring that the Subscriber receives and activates their subscription.

1.4. The subscription is personal to the Subscriber and may not be transferred, exchanged for cash, or shared with another individual.

1.5. By activating their subscription and/or accessing the Open Water online portal, the Subscriber agrees to be bound by these Terms & Conditions.

1.6. The Open Water subscription will commence on from the date when your application is accepted by our Head of Open Water.

2. Fee

2.1. The Fee of £150 covers a one-month subscription period.

2.2. The Fee must be paid in full and in a single transaction by either the Purchaser or the Subscriber.

2.3. Once the subscription has been activated, it is non-refundable and non-transferable.

2.4. No refunds will be issued for any unused portion of the subscription period.

3. Open Water Digital Card

3.1. The Subscriber will receive a digital subscription card upon joining the Open Water portal.

3.2. Subscribers must not permit their digital card to be used by any other person. Misuse may result in suspension or cancellation of the subscription.

4. Open Water Online Portal

4.1. As part of the subscription, the Subscriber will receive login details to access the Open Water online portal.

4.2. Login details must not be shared. Misuse of the portal may result in suspension (pending investigation) or termination of the subscription, at Rockwater’s discretion.

5. Guests

5.1. Subscribers may bring one guest to designated subscriber events, where specified.

5.2. Unless expressly stated otherwise, under-18s are not permitted at subscriber events.

5.3. At designated family events, subscribers’ children are welcome to attend.

6. Personal Information

We will handle all personal information provided in connection with the subscription in accordance with our Privacy & Cookie Policy, available at www.rockwater.uk.

7. Bills

All bills must be settled in full before leaving Rockwater. Rockwater does not operate any credit facilities.

8. Filming & Photography

8.1. Events and activities at Rockwater may be filmed or photographed.

8.2. These images and recordings may be used on our website, social media channels, and in marketing or promotional materials.

8.3. By attending these events, the Subscriber and their guests consent to such use without the need for further permission.

9. Conduct

9.1. The Subscriber agrees to be responsible for, and to indemnify Rockwater against, any damage caused to Rockwater property by the Subscriber or their guests.

9.2. Rockwater reserves the right, at its absolute discretion, to suspend (pending investigation) or cancel a subscription if a Subscriber’s conduct is deemed detrimental to Rockwater, its staff, guests, or other members.

9.3. Any refund of the Fee, in whole or in part, shall be at Rockwater’s sole discretion.

10. Amendments to Terms & Conditions

Rockwater may update these Terms & Conditions from time to time. Notification of any changes will be displayed on the Open Water portal. The most recent version of the Terms & Conditions will always apply and may supersede the version in place when the subscription was purchased.

11. Liability

Rockwater shall not be liable to any Subscriber, Purchaser, or guest for any loss, damage, or injury suffered by them or their property, however caused, except in cases of death or personal injury directly resulting from Rockwater’s negligence.
